Part I — 18 U.S.C. § 2257 Record-Keeping Compliance Statement

1. Compliance Statement

Night Protocol LLC, operator of the domains listed at the end of this document (the "Platform"), is committed to full compliance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75 (collectively, the "Act"). The Act requires that producers of visual depictions of actual sexually explicit conduct maintain certain age-verification and identification records for all performers depicted.

All visual depictions displayed on this Platform of actual sexually explicit conduct, simulated sexual conduct, or other content as defined in 18 U.S.C. § 2256(2) were produced by persons or entities other than Night Protocol LLC ("Secondary Producer"). Night Protocol LLC functions as a secondary producer under the Act in connection with such content.

2. Age Verification

Every performer depicted in sexually explicit content on this Platform was, at the time such visual depictions were produced, at least 18 years of age. Night Protocol LLC does not knowingly permit or host content depicting individuals under the age of 18 in any sexual context.

The Company has a zero-tolerance policy for any such content and will immediately remove and report any content suspected of depicting minors to the National Center for Missing and Exploited Children (NCMEC) CyberTipline and relevant law enforcement agencies, as required by 18 U.S.C. § 2258A.

3. Records Custodian

In accordance with 18 U.S.C. § 2257 and 28 C.F.R. § 75.2, records required under the Act are maintained by the Company's designated third-party records custodian.

The records custodian is responsible for inspecting, maintaining, and making available for inspection all required records as prescribed by 28 C.F.R. Part 75. Records are available for inspection during normal business hours upon proper request made pursuant to 28 C.F.R. § 75.5.

4. Content Produced by Users

Certain content on this Platform is submitted by registered users who, in their capacity as primary producers, are independently responsible for compliance with the Act. Night Protocol LLC, as a secondary producer, requires that all users who submit sexually explicit content represent and warrant that:

• All performers depicted are at least 18 years of age
• Primary producers have obtained and maintain records in full compliance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75
• Such records are available for inspection upon lawful request
• All content complies with applicable federal and state law

Users who submit sexually explicit content are required to provide required identification documentation to the Company's designated records custodian as a condition of uploading such content. Failure to comply will result in content removal and account termination.

5. Operator Exemption

To the extent Night Protocol LLC qualifies as an "Internet content hosting provider" or falls within any safe harbor or exemption under 18 U.S.C. § 2257A or applicable regulations with respect to user-submitted content, the Company asserts and reserves all such exemptions. Nothing in this Statement waives or limits the Company's eligibility for any applicable exemption.

6. Reporting Suspected Minor Exploitation

Any person who becomes aware of content on the Platform that may depict a minor in a sexual context is encouraged to report it immediately through the Platform's reporting tools or by contacting us directly. The Company will review all such reports promptly and report credible violations to NCMEC's CyberTipline at www.missingkids.org.

Part II — Content Creator Release and Age Verification Agreement

This Content Creator Release and Age Verification Agreement ("Release") is entered into between Night Protocol LLC ("Company") and the individual or entity registering as a content creator on the Platform ("Creator"). By registering as a content creator or submitting any User Content to the Platform, Creator agrees to be bound by all terms of this Release.

1. Representations and Warranties

Creator represents, warrants, and covenants that:

• Creator is at least 18 years of age
• All performers depicted in Creator's submitted content are at least 18 years of age at the time of production
• Creator has personally verified the age and identity of all performers through government-issued photographic identification
• Creator has obtained and retains executed written consent and release from each performer
• Creator has produced or possesses copies of identification documents required under 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for each performer depicted
• Creator has provided or agrees to provide copies of all required documentation to the Company's designated records custodian prior to or concurrent with content submission
• All content submitted is original, legally obtained, and does not infringe any third-party rights
• Creator has full authority to grant the rights set forth herein

2. Grant of Rights

Creator grants to Night Protocol LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and transmit Creator's submitted content through the Platform and in connection with the Company's services. This license continues for the period during which the content remains on the Platform and survives any termination solely to the extent necessary to fulfill legal compliance obligations.

3. Records Submission

Creator agrees, as a condition of submission, to deliver to the Company's designated records custodian the following documentation for each performer depicted in sexually explicit content:

• A legible, complete copy of one government-issued photographic identification document bearing the performer's name and date of birth
• A completed and executed 2257 performer disclosure form as provided or approved by the Company
• Any additional documentation required under applicable law

Failure to provide required documentation within the time period specified by the Company will result in removal of the relevant content and may result in account suspension or termination.

4. Indemnification

Creator agrees to indemnify, defend, and hold harmless Night Protocol LLC, its members, managers, officers, employees, agents, and assigns from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Creator's submitted content; (b) any breach of Creator's representations, warranties, or obligations under this Release; (c) any claim that Creator's content violates applicable law; or (d) any claim by a performer depicted in Creator's content.

5. Termination and Survival

This Release remains in effect for so long as any submitted content remains on the Platform or for so long as required by law, whichever is longer. Creator's indemnification obligations and record-keeping representations survive any termination of this Release or Creator's account.
